June 2017 Case Conclusions
Below is a list of Warnken, LLC’s permanent or temporary case conclusions for June 2017. This consists of a mix of workers’ compensation cases and personal injury cases. It’s important to recognize that success in one particular case does not necessarily mean success in your case. Every case is different, and the value of the case is likely different. June 2017 Cases
- Injury: Chronic traumatic right knee patellar tendinosis/tendinopathy
- Body Part: Knee
- Amount: $3,960.00 (total compensation is $15,840.00)
- Claimant reopened the claim for worsening of condition due to continued complaints. Claimant received additional physical therapy and was able to return to work.
- Injury: Subcutaneous hematoma and MCL sprain
- Body Part: Right knee
- Amount: $7,776.00
- Claimant was injured after tripping on an uneven walkway causing Claimant to fall onto the knee. Claimant underwent surgery to remove the hematoma that developed.
- Injury: Full thickness burn of the right knee w/ complex wound and deep burns
- Body Part: Right knee and left hand
- Amount: $39,273.50
- Claimant was injured after sustaining an electric shock that entered the body through the hand and left the body at the right knee. Claimant underwent skin grafting surgeries and surgery to close the wounds. Claimant underwent physical therapy and was able to return to pre-injury employment.
- Injury: Torn ACL and CRPS/RSD with implantation of spinal cord stimulator
- Body Part: Left knee
- Amount: $44,955.00
- Claimant was injured during physical training exercises at work. Claimant underwent 2 surgeries to the left knee. Following the second surgery, Claimant developed CRPS/RSD in the left lower extremity. Claimant had a spinal cord stimulator placed in the spine as a result to help with the pain.
- Injury: Left proximal humerus fracture; right facial laceration
- Body Part: Left shoulder/arm and face
- Amount: $31,870.00 ($24,000 settlement plus MCP of $7,870.00)
- Claimant was injured after falling at work. Claimant underwent surgery in the emergency room to fix the left humerus fracture and received stitches for the laceration. Claimant received physical therapy following the surgery.

- Amount: $9,000.00
- Claimant was injured after a steel beam fell on the claimant’s foot. Claimant’s injury was stitched and was treated with a walking boot and air cast.

- Claimant slipped and fell on icy steps and injured foot. Claimant missed two weeks of work. Treatment required rest.
- Injury: Fracture

- Amount: $3,087
- Claimant was had hand slammed in the tailgate of work truck. Claimant was placed in a splint until the bone healed; missed approximately 1-2 weeks from work, returned on light duty restrictions for a brief period prior to full duty release.

- Claimant slipped and fell when making a delivery to a customer’s home. Xray was negative for any fractures and MRI which was negative for any tears. After a course of physical therapy, injured worker was released without restriction.
- Injury: Adhesive capsulitis

- Injured worker had an initial course of physical therapy but subsequently developed frozen shoulder, which required surgical intervention, followed by additional PT.
- Injury: Torn medial and lateral meniscus
- Body Part: Knee
- Amount: $35,000
- Claimant stepped off a curb injuring knee; MRI revealed a tear of the lateral and medial menisci. Treatment included an arthroscopy and physical therapy. Claimant missed approximately 2.5 weeks of work after surgery before returning on a light duty basis.
- Injury: Fifth metatarsal fracture
- Body Part: Foot
- Amount: $4,500
- Claimant stepped into a gap between pavement and injured foot. He was placed in a working boot while the fracture healed. He did not require any physical therapy but was instructed to comply with a home exercise program. He missed 1 week of work before returning on light duty sedentary work only.
- Injury: Hypertension

- Amount: $8,334.87
- As a result of the stresses of job as a law enforcement officer, the Claimant developed hypertension.
- Injury: Distal phalanx fracture
- Body Part: Big toe
- Amount: $2,332.40
- Claimant injured his big toe when it was ran over by a pallet jack. He was placed in orthotic footwear while the bone healed. He did not require any formal therapy. He was able to work sedentary duties while he recovered.
- Injury: Laceration
- Body Part: Thumb
- Amount: $1,500
- Claimant cut his thumb opening boxes with a pair of scissors. The injury required stitches but no formal treatment. The Claimant was compensated for the scar on his thumb.
- Injury: Fracture 5th metacarpal
- Body Part: Hand
- Amount: $10,000
- Xrays revealed a small hairline fracture on his knuckle.
- Injury: Various
- Body Part: Neck, right shoulder, thoracic spine, lumbar spine
- Amount: $34,300.00
- Treatment included extensive physical therapy over several months, in addition to a low back and right shoulder injection. Two months from work prior to returning on a light duty basis.
- Body part: Elbow/arm
- Amount: $20,000
- Claimant was repairing a truck when a suspension bag exploded, causing a fracture to the elbow. The injury required surgery, a splint, and physical therapy.
- Body part: Shoulder
- Amount: $8,750
- Claimant was injured while demonstrating defensive techniques. Diagnosis included a partial tear of the the rotator cuff. Treatment included an arthroscopic surgery and physical therapy. The case was settled in addition to a previous award of $9,520.

- Amount: $14,500
- Claimant’s back was twisted while moving a heavy table. Diagnosis was a lumbar strain, with treatment consisting of medication and therapy.
