September 2018 Case Results from Workers’ Compensation and Other Personal Injury Cases
Below are the results from Warnken, LLC workers’ compensation and personal injury cases that concluded – either for now or permanently – last month. No two cases are exactly the same and just because we got a great result in one particular case doesn’t mean that all cases will produce the same. For example, if we’re asked how much is a SLAP tear worth in workers’ compensation, we’re not going to say $310,000 even though you will see that result below. - Claimant slipped and fell on ice at work. Claimant had surgery to repair the torn meniscus followed by physical therapy.

- Claimant was injured after lifting a heavy object at work. Claimant underwent a multi-level fusion. The claim was reopened for additional physical therapy.

- Plaintiff injured back, neck, and shoulder in a motor vehicle accident. The treatment was conservative in nature consisting of physical therapy. The Plaintiff did not miss any time from work.

- Claimant was working as a nursing assistant and tried to prevent a patient from falling when the shoulder injury occurred. Prior to an MRI a course of physical therapy begun. A subsequent MRI revealed the tear of the rotator cuff. Claimant then came under the care of an orthopedic surgeon who performed an open rotator cuff repair followed by a course of post-operative physical therapy, work hardening, and functional capacity evaluation resulting in a full duty discharge.

- Claimant injured back and hip pulling a bin of dirty linen while working as a janitor. Claimant’s treatment included one injection, two sessions of physical therapy, and time off from work.
- Injury: Rupture of bicep tendon
- Body: Arm
- Amount: $26,325.00
- Claimant sustained an arm injury will trying to maneuver a heavy piece of machinery. The diagnosis was a traumatic bicep tendon rupture requiring surgical repair. Claimant underwent a course of post-op physical therapy and working hardening before returning to work with the same employer.

- Claimant sustained injury to the back, neck, shoulder and ankle after slipping and falling while unloading a moving van. An MRI of the shoulder revealed a tear of the supraspinatus, an ankle MRI showed a chronic partial tear of the ATFL, MRIs of the neck and back revealed multiple disk protrusions. The Claimant underwent physical therapy and spinal injections.

- Claimant sustained an ankle injury while attempting to catch a falling patient. The Claimant’s sprained ankle was immobilized for a period of time and the Claimant underwent physical therapy.
- Injury: SLAP tear of the shoulder

- Claimant’s shoulder injury occurred while attempting to open a heavy train door. An initial surgery was performed in the form of an anterior labrum repair with open biceps tenodesis and tenotmy. This was followed by physical therapy and pain management. A second surgery was subsequently required which consisting of arthroscopic debridement, capsular release and decompression. Upon completion of additional post-op therapy the Claimant was unable to return to preinjury employment due to permanent work restrictions.

- Body: Shoulder, knee
- Amount: $92,853.16
- Claimant was working at a long term care facility as a nursing assistant when injury was sustained to the shoulder and knee due to a slip and fall. MRIs of the knee revealed a complex tear of the medial meniscus and tendinosis of the rotator cuff tendon in the shoulder. Claimant would undergo surgery to both the knee and shoulder, which was followed by post-operative therapy and injections. The Claimant was under permanent work restrictions upon discharge.
