Case Conclusions for February 2020

Sometimes, tradition is so important.  You do something because that’s the way you always do it.  Every month, I post our case conclusions from real cases.  I started in May 2014 and I have done it every month.  Here’s that first results post.

The only reason I can even bring myself to post the results this month is because I always do it.  We had an okay month – we recovered $498,761.  As our months go, it’s nothing special these days.  However, for so many of the clients represented below, those recoveries really meant something.

The reason I can’t get excited to write about Warnken, LLC is because I’m really scared for the front line workers in the face of Covid-19.  So many of these folks are our clients.  They need money.  We all need money.  But these folks are getting put in harm’s way so they can get their money.  Keep them in your prayers.

February 2020 Case Conclusions…

  • Injury: Traumatic wound dorsal foot and chronic lumbarsacral strain
  • Body Part: Foot and Back
  • Amount: $70,000.00 plus MSA of $16,000
  • Claimant slipped at work causing a wound on the foot. Due to pre-existing conditions, the wound would not heal and multiple wound cleansing procedures were performed over time. Claimant’s back was added to the claim due to altered gait.

 

  • Injury: Corneal abrasion, anxiety, and headaches
  • Body Part: Eye, Psych, Head
  • Amount: $12,320.00
  • Claimant was struck in the eye with a plug. Claimant developed anxiety and headaches from the original injury. Claimant was able to continue with pre-injury employment.

 

 

  • Injury: Torn rotator cuff
  • Body Part: Shoulder
  • Amount: $27,375.00
  • Employer: Maryland State Police
  • Claimant fell from a chair at work injuring the shoulder. Claimant underwent surgery to the shoulder to repair the torn rotator cuff. Claimant had post-operative therapy and returned to pre-injury employment.

 

  • Injury: Ankle Fracture, Neck Strain
  • Body Part: Foot/Ankle, Neck
  • Amount: $34,300.00
  • Location: US Route 50
  • Claimant was involved in a motor vehicle collision during the course of employment sustaining injuries to the neck and foot/ankle. Initially xrays of the lower extremity did not reveal any fractures. Claimant eventually had an MRI of the foot/ankle which revealed a fracture of the lateral talar dome. Claimant underwent surgery in the form of an arthroscopic repair of the osteochondral defect, extensive arthroscopic synovectomy, peroneal tenolysis and Bostrom lateral ligament reconstruction.  Claimant also underwent a course of physical therapy for the cervical spine strain.

 

  • Injury: Fractured Humeral Head
  • Body Part: Shoulder
  • Amount: $45,625.00
  • Location:        Baltimore, MD
  • Claimant was working in an educational setting when clmnt slipped and fell, resulting in a fractured shoulder. An MRI was also performed which revealed a partial tear of the supraspinatus and a low-grade partial tear of the subscapularis myotendinous junction.  Claimant was treated conservatively with a sling, pain medicine, physical therapy and acupuncture.

 

  • Injury: Fractured Fibula
  • Body Part: Leg
  • Amount: $18,500.00
  • Employer: Arena Football One, LLC
  • Location: Wells Fargo Center, Philadelphia, PA
  • Claimant sustained injury to the leg while playing professional football. Claimant was treated with a walking boot followed by physical therapy.

 

  • Injury: Back Sprain
  • Body Part: Back
  • Amount: $18,000.00
  • Employer: Arena Football One, LLC
  • Location: Royal Farms Arena, Baltimore, MD
  • Claimant sustained injury to the back while playing professional football.

 

  • Injury: Tear of TFCC
  • Body Part: Hand
  • Amount: $9,150.00
  • Claimant was working as an environmental chemist and sustained injury to the hand while moving a 30-gallon barrel. Claimant was treated with medication and physical therapy.  An MRI was eventually performed of the wrist which showed a high-grade tear of the lateral third and ulnar attachment of the TFCC.  Claimant underwent surgery in the form of TFCC repair.

 

  • Injury: Mallet Finger, Dog bite
  • Body Part:      Middle finger, Leg
  • Amount: $2,739.00
  • Claimant was working as a delivery driver when he was bit by a dog on a route. Claimant sustained an injury to the leg, and finger due to the fall.  Claimant underwent pinning of the middle finger, followed by removal of the pin, and also conservative care to the scar, before being released back to full duty.

 

  • Injury: Traumatic lateral epicondylitis
  • Body Part:      Elbow
  • Amount: $36,000.00
  • Claimant sustained a slip and fall while working as a server in a restaurant. Claimant underwent physical therapy and injections.  Claimant was able to eventually return to different employment.

 

  • Injury: Shoulder strain, cervical disc protrusion
  • Body Part:      Back, shoulder, neck
  • Amount: $14,000.00
  • Claimant sustained an injury while lifting a patient working as a certified nurses assistant. Claimant underwent an MRI that revealed a disc protrusion in the neck. Claimant had treatment in the form of physical therapy, and was able to return to a work with a different employer.

 

 

  • Injury: Radial Styloid Injury
  • Body Part:      Hand
  • Amount: $8,500.00
  • Claimant underwent an X-ray and EMG which were unremarkable. Claimant treated with an injection, physical therapy, and pain management.  Claimant was ultimately released back to work with a different employer.

 

 

  • Injury: Fractured little finger (pinky)
  • Body Part:      Finger
  • Amount: $3,487.50
  • Claimant was working as a correctional officer when, while breaking up a fight, injured her pinky. Claimant was diagnosed with a fracture of the finger, and underwent a percutaneous pinning.  Post-operative care was in the form of a split, physical therapy, and having the pin removed.  Claimant was able to return to pre-injury employment.

 

 

  • Injury: Cervical and lumbar stains that aggravated pre-existing degenerative disc disease, and PTSD
  • Body Part: Neck, Back, Psychological
  • Amount: $63,947.00.  AFCS, including MSA
  • Location: Talbot County
  • Claimant sustained physical injuries to his neck and back as well as psychological injuries as a result of a motor vehicle collision.

 

 

  • Injury: Inguinal hernia
  • Body Part: Abdomen/Groin
  • Amount: $9,000.00, plus payment of all medical care including surgery.
  • Location: Anne Arundel County
  • Claimant sustained a hernia while lifting heaving pipes at a construction site. Claim was settled “contested” due to issues with proper notice of the hernia.

 

 

  • Injury: Tear of the tibialis anterior tendon with retraction.  Tear of the extensor hallucis tendon.  Grade II tear of the peroneus longus tendon.
  • Body Part: Leg, Ankle, Foot
  • Amount: $42,500.00.
  • Location: Baltimore City
  • Claimant sustained an injury to his lower extremity when he felt a “pop” while pushing a container.

 

 

  • Injury: Lumbar sprain/strain with articular dysfunction superimposed on prior lumbar injuries.
  • Body Part: Low Back
  • Amount: $3,740.00
  • Location: Carroll County
  • Claimant sustained injury while assistant an elderly resident. Resident kicked at her, causing Claimant to lose her balance and sustain injury to her back and pelvis.

 

 

  • Injury: Myalgia and myofascial pain of the lumbar spine.  Right Shoulder AC Joint sprain, right wrist sprain.
  • Body Part: Head, Neck, Shoulder, Wrist and Back
  • Amount: $11,895.00.
  • Location: Baltimore City
  • Employer: Caesars Entertainment Corp.
  • Claimant sustained injuries during an altercation at the craps table at the Horseshoe Casino at the time of the incident.

 

 

  • Injury: Laceration of the scalp that exacerbated a lipoma that required excision surgery to remove.    Cervicalgia and radiculopathy.
  • Body Part: Head and Neck
  • Amount: $15,000.00
  • Location: Carroll County
  • Claimant sustained injury when a steel plate struck claimant in the head.

 

 

  • Injury: Avulsion fracture of the fifth carpal metacarpal.
  • Body Part: Hand
  • Amount: $10,037.50
  • Location: Montgomery County
  • Claimant sustained injury to the hand due to a motorcycle accident during training.

 

 

  • Injury: Head contusion and post-concussion syndrome.  Cervio-occipital neuralgia.
  • Body Part: Head, Neck and Back
  • Amount: 10% PPD, 2% head, 2% neck, 3% back and 3% pre-existing back. $6,405.00
  • Location: Baltimore County
  • Claimant sustained injuries to his head, neck and back due to a motor vehicle collision.

 

 

  • Injury: Fractured distal radius requiring open reduction and internal fixation surgery.
  • Body Part: Wrist/Hand
  • Amount: 25% PPD to the right wrist. $11,687.50
  • Location: Howard County
  • Claimant slipped and fell on ice in the Employer’s driveway.

 

 

  • Injury: Bilateral fractures of the superior and inferior pubic rami.
  • Body Part: Back, Ribs, Pelvis
  • Amount: $10,000.00 Indemnity with payment of all post-injury medical bills.
  • Location: Baltimore City
  • Claimant sustained injuries while exercising a horse. The horse reared up, flipped and landed on Claimant.   Claim was settled “contested” due to issues with “casual employment” and “independent contractor.”

 

 

  • Injury: Partial tear of the medial meniscus requiring a partial medial meniscectomy, debridement, and partial chondroplasty surgery.
  • Body Part: Knee
  • Amount: $40,000.00 AFCS.
  • Location: Prince George’s County
  • Claimant sustained a twisting injury to the knee after stepping off a concrete pad at a construction site.
