Below is a sampling of Warnken, LLC’s October 2017 case conclusions – either full and final settlements or PPD awards.  In all cases below, the settlement represented the injured parties indemnity money in a workers’ compensation case.  This means that it’s money designed to compensate the injured worker for loss of function and use of the body moving forward.  On top of this money, the injured worker generally received medical benefits and wage replacement in the form of temporary total disability payments.

  • Injury: Subacute subchondral fracture at the medial femoral condyle
  • Body Part: Left knee
  • Amount: $27,783.00
  • Claimant was injured after slipping and falling on ice. Due to Claimant’s injury, he underwent a total knee replacement.

 

  • Injury: Partial tear of the supraspinatus
  • Body Part: Left shoulder
  • Amount: $21,450.00 (total award of $51,150.00)
  • Claimant was injured after moving a patient at work. Claimant underwent surgery to the left shoulder for a partial tear of the supraspinatus.

 

  • Injury: Lumbar strain, rotator cuff tear, SLAP tear
  • Body Part: Left shoulder and back
  • Amount: $25,000 (total award of $36,760.00)
  • Claimant was injured after slipping and falling on ice at work. Claimant underwent arthroscopic surgery to the left shoulder to repair the SLAP tear and rotator cuff tear. Claimant was treated conservatively for the back.

 

  • Injury: Sublaxation of the patella
  • Body Part: Left knee
  • Amount: $2,826.00 (total award of $28,260.00)
  • Claimant reopened the workers’ compensation claim for additional treatment. Claimant underwent additional physical therapy.

 

  • Injury: Disc bulge at L5-S1
  • Body Part: Back
  • Amount: $24,035.48
  • Claimant was injured after lifting heavy objects at work. Claimant was treated conservatively with physical therapy and injections.

 

  • Injury: Bone marrow edema and bone contusions
  • Body Part: Wrist
  • Amount: $1,505.00 (total award of $6,450.00)
  • Claimant was injured after falling at work. Claimant was treated conservatively with physical therapy and medication.

 

  • Injury: Compression fracture at T11-12 and meniscal tear
  • Body Part: Back and knee
  • Amount: $34,300.00
  • Claimant was injured after slipping and falling at work. Claimant was treated conservatively for the back injury. Claimant underwent arthroscopic surgery to repair the torn meniscus.

  • Injured client was in a motor vehicle crash while working.

 

  • Injury: Carpal tunnel
  • Body Part: Hand/wrist

  • Claimant’s underwent a left endoscopic carpal tunnel release after an EMG confirmed CTS. He returned to work the day after the procedure and missed no time from work.

 

  • Injury: ACL & mensicus tear
  • Body Part: Knee

  • Claimant underwent a surgical repair that was followed by post-op PT. He required a course of work hardening before returning to work.

 

  • Injury: Fracture
  • Body Part: Hip
  • Amount: $11,500
  • Claimant slipped and fell at work. She underwent a surgical repair followed by inpatient rehabilitation, and then outpatient physical therapy. She was 87 at the time and had a low AWW.  Stipulated to 125 weeks; 25% whole person.

 

  • Injury: Medial malleolar fracture
  • Body Part: Ankle (Broken ankle)
  • Amount: $60,000.00
  • Claimant injured his foot/ankle when another employee accidentally ran over it with a pallet jack. The Claimant underwent a surgical repair with hardware. Approximately 6 months later the Claimant underwent a second procedure to remove the hardware, which was followed by a course of physical therapy.

 

  • Injury: de quervains tenosynovitis
  • Body Part: Hand/wrist

  • Claimant developed de quervain’s tenosynovitis. She underwent a surgical release that was followed by a course of occupational therapy.

  • Claimant injured herself at work repositioning a heavy patient. There were no surgical indications but she did undergo months of hand therapy.
