The Big Warnken Giveaway Terms and Conditions
Warnken, LLC (hereinafter “Warnken” or “The Firm” or “Sponsor”) desires to have a sweepstakes promotion.
Sponsor = Warnken, LLC 2 Reservoir Circle, STE 200 Baltimore, MD 21208
Entrant/Participant (hereinafter “Entrant” or “Participant”) desires to participate in sweepstakes promotion for a chance to win prizes.
All Terms and Conditions described herein below are part of the “Sweepstakes Promotion” (hereinafter “Sweepstakes” or “Promotion” or “Big Warnken Giveaway” or “Giveaway”) and shall form a contract between Warnken, LLC and any participant. Please read carefully.
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR ATTORNEY-CLIENT RELATIONSHIP WITH WARNKEN, LLC WILL NOT IMPROVE YOUR CHANCE OF WINNING. BY ENTERING, YOU AGREE TO THESE OFFICIAL RULES, TERMS, AND CONDITIONS, WHICH ARE A CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. WITHOUT LIMITATION, THIS CONTRACT INCLUDES INDEMNITIES FROM YOU AND A LIMITATION OF YOUR RIGHTS AND REMEMDIES.
PRIZES
If the Ravens make the Playoffs in the 2022-2023 season, five (5) winners shall receive $1,000 each. (The Playoff Prizes)
If the Ravens are the winner of the Super Bowl LVII on February 12, 2023
one (1) winner shall receive $100,000. (The Grand Prize)
If the Ravens are not the winner of the Super Bowl LVII on February 12, 2023
one (1) winner shall receive $1,000. (The Participation Prize)
All prizes have a combined total approximate retail value of $105,000 if the Ravens win the Super Bowl. All prizes have a total approximate retail value of $5,000 if the Ravens make the playoffs but do not win the Super Bowl. All prizes have a total approximate retail value of $1,000 if the Ravens neither make the playoffs nor win the Super Bowl.
Time of Sweepstakes
The Giveaway shall begin on 12:01am (Eastern Standard Time; hereinafter “time in Baltimore, Maryland”) August 24, 2022 and shall conclude on February 11, 2023 at 12:00pm (time in Baltimore, Maryland).
NO PURCHASE NECESSARY
Participant has no requirement to do anything except enter via method of entry or alternative method of entry. Specifically, Participant has no requirement to purchase anything or to listen to, or otherwise be subject to, any sales pitch.
REQUIREMENTS AND RESTRICTIONS
LIMIT ONE ENTRY PER PERSON. MUST BE 18 YEARS OF AGE AND A LEGAL RESIDENT OF MARYLAND TO PARTICIPATE AND TO BE ELIGIBLE TO WIN PRIZES. Entrant must turn 18 years of age on or before August 24, 2022. Winner(s) must be prepared to show photo identification to prove age. Entrant must be a permanent resident of Maryland for one or more days during the contest period.
No employee of Warnken, LLC or family member of an employee of Warnken, LLC or family member of Byron B. Warnken, Esq. is eligible to participate in the Giveaway.
Winners agree that participation in the Sweepstakes and acceptance of a prize constitutes permission for Sponsor to use his or her name, likeness, picture, voice, and/or statements made by the winner for advertising and promotional purposes without notice or additional compensation unless otherwise prohibited by law.

METHOD OF ENTRY
Follow @warnkenlaw on Instagram to enter. All followers who meet other requirements will be eligible to win. Entrant must follow @warnkenlaw.com not later than February 11, 2023 at 12:00pm (time in Baltimore, Maryland) and must follow until at least February 17, 2023 at 12:00pm (time in Baltimore, Maryland) to win the Grand prize or the Participation prize.
Entrant must follow @warnkenlaw.com not later than January 11, 2023 at 12:00pm (time in Baltimore, Maryland) and must follow until at least January 18, 2023 at 12:00pm (time in Baltimore, Maryland) to win the Playoff prizes.
ALTERNATE METHOD OF ENTRY
Anyone may participate in the Giveaway by entering via the Alternate Method of Entry (“AMOE”). In order to participate via the AMOE, simply send a postcard or letter to:

Mail-in alternative method of entry shall include name, phone number, email address, and address of residence.
All mail-in alternative method of entry entries received by February 8, 2023 will be eligible to win the Grand prize or the Participation prize.
All mail-in alternative method of entry entries received by January 11, 2023 to be eligible to win the Playoff prize.
DISABLING EVENT – RIGHT OF CANCELLATION – “MONKEY BUSINESS”
If Instagram in any way disables, turns off, disqualifies, eliminates, deletes, or otherwise hampers the ability of @warnkenlaw to take entries or disseminate messaging about the Giveaway (“Platform disabling event”), all communications about the Giveaway shall be posted on www.warnkenlaw.com/news. In the event of such a Platform disabling event, Warnken, LLC reserves the right to conduct the contest from that point forward with only the entrants as had been collected by Warnken, LLC to that point forward. Warnken, LLC shall endeavor to gather, collate, and record followers on an at least weekly basis from the inception of the Giveaway until the conclusion of the Giveaway. In the event of such a Platform disabling event, Warnken, LLC reserves the right to use good faith efforts to award winners.
Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this Sweepstakes should (in its sole discretion) virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, Sponsor will select the winner(s) from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Sweepstakes or website. Sponsor may prohibit an entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives.
WINNERS SELECTION
All entrants via method of entry or alternative method of entry shall be entered into database or Excel spreadsheet and shall be selected via random computer number generator. These drawings shall either be live or recorded and, whether live or recorded, shall be published online at the following locations: @warnkenlaw Instagram account, www.warnkenlaw.com/news, and other Warnken, LLC social media accounts as applicable. Winner shall have forty-eight (48) hours to respond to an Instagram direct message, phone call, or email. If any winner does not respond within forty-eight (48) hours of first notification attempt, if any prize or prize notification is returned as undeliverable, if any winner rejects his/her prize or in the event of noncompliance with these Sweepstakes rules and requirements, such prize will be forfeited and an alternate winner will be selected from all remaining eligible entries. Upon prize forfeiture, no compensation will be given. Limit one prize per person or household.
Winner shall also be required as quickly as reasonably practicable (and in any event within 48 hours of notification) to sign an affidavit of eligibility.
TAXES ARE THE SOLE RESPONSIBILITY OF THE WINNER
Winner(s), at his or her sole obligation, shall be obligated to pay any and all applicable taxes. Winner(s) shall be obligated to complete and fill out a W9 IRS tax form in order be eligible to claim prize.
Odds of Winning
Odds of winning are dependent upon number of entries.
LIMITATION OF LIABILITY; DISCLAIMER OF WARRANTIES
By participating, entrants and winners agree to release and hold harmless, Sponsor, Facebook, Inc., Instagram, Meta Platforms, Inc., and their respective advertising and promotion agencies and their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors (collectively, “Released Entities”), from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in Sweepstakes, or possession, acceptance and/or use or misuse of prize or participation in any Sweepstakes-related activity and for any claims based on publicity rights, defamation or invasion of privacy and merchandise delivery.
IN NO EVENT WILL THE RELEASED ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE SERVICE AND/OR THE SWEEPSTAKES, DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY WEBSITES ASSOCIATES WITH THE SWEEPSTAKES. IN NO EVENT SHALL THE RELEASED ENTITIES’ TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED $1. WITHOUT LIMITING THE FOREGOING, THIS SWEEPSTAKES AND ALL PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT
Forum Selection Clause
Sponsor Warnken, LLC is a personal injury law firm representing injured parties. We take on insurance companies and big business. We do not support limitation of the right to trial by jury and do not limit such a right herein.
THESE OFFICIAL RULES AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF MARYLAND WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES. The parties irrevocably submit and consent to the exclusive jurisdiction and venue of the state and federal courts located in or closest to Baltimore County, Maryland in the State of Maryland. The parties agree not to raise the defense of forum non conveniens.
Invalidity/Unenforceability
In the event any provision of these terms and conditions (the Agreement) shall be deemed invalid, unenforceable, no other provision shall be impacted and these Terms and Conditions (the Agreement) shall remain in force and effect. One or more invalid or unenforceable provisions do not invalidate any other provision.
Force Majeure and Acts of God or Terrorism
In the event an insufficient number of eligible entries are received and/or Sponsor is prevented from awarding prizes or continuing with the Sweepstakes as contemplated herein by any event beyond their control, including but not limited to fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control then subject to any governmental approval which may be required, Sponsor shall have the right to modify, suspend, or terminate the Sweepstakes. If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select the winner in a random drawing from all eligible, non-suspect entries received as of the date of the event giving rise to the termination. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances. Only the type and quantity of prizes described in these Official Rules will be awarded.
