What are the Current Workers’ Compensation Rates for Maryland?

Below are the workers’ compensation rates for Maryland in 2022.

After stagnant or decreasing workers’ comp rates in Maryland in the last few years, the rates for 2022 are significantly increased.  This is good for injured workers.  Workers’ compensation is not perfect, but this is a relevant improvement.

Temporary Total Disability

Temporary total disability (TTD) is the payment you are entitled to receive from the workers’ compensation insurer when you are completely unable to work.  This is the workers’ compensation method of wage replacement.

The rate for TTD in Maryland workers’ compensation is 2/3 of your Average Weekly Wage (AWW), not to exceed $1,338.00.  This is an increase from the 2021 maximum rate of $1,050.00.

Temporary Partial Disability

Temporary partial disability (TPD) is wage replacement for when you are working but making less money as the result of your injury.  The rate for TPD is 50% of the difference between what you were making before the injury (your AWW) and what you are making after because of the injury.  The temporary partial disability payment cannot exceed $669.00.  This is up from $525.00 in 2021.

What is the Compensation for Permanent Injuries in Workers’ Comp?

Permanent Total Disability

Perm total is compensation you receive when and if you are permanently unable to work at all.  In many cases, there is a specific hierarchy of employment that must be tried before perm total is reached.  This often includes vocational rehabilitation in Maryland workers’ comp.

The rate for PTD in Maryland workers’ compensation is 2/3 of your Average Weekly Wage (AWW), not to exceed the State Average Weekly Wage, for life.

Permanent Partial Disability

Permanent partial disability (PPD) is the compensation you are entitled to for the impairment to your body after a work injury.  The calculation of PPD is complex and one of the important reasons you need a workers’ comp attorney for your case.

The rate of PPD you receive depends on the number of weeks of compensation that you are awarded.  There are three tiers of injuries:

  • First tier – Less than 75 compensable weeks (Minor disability)
  • Second tier – 75-249 compensable weeks
  • Third Tier – 250 or more compensable weeks

 

Workers’ Compensation Rates in Maryland for 2022

The 2022 injury rates are as follows:

  • If you are awarded less than 75 weeks, you are entitled to compensation for those awarded weeks at a rate of 1/3 of your AWW, not to exceed $224/week
  • If you are awarded 75 weeks or more, but less than 250 weeks, you are entitled to compensation for those awarded weeks at a rate of 2/3 of your AWW, not to exceed $446/week
  • Cases awarded 250 weeks or more are considered “Serious Disability” under the Maryland workers’ compensation system. The rate for serious disability in Maryland comp is 75% of your AWW, not to exceed $1,004/week.  Therefore, an award of 250 weeks with a maxed out average weekly wage would be worth around a quarter of a million dollars.
