We Recovered $14,419,589.87 for the Injured in 2020
2020 was a rough year for our society. Everything was different – habits, work, travel, dining, socializing, the holidays, education. You name it. There wasn’t much that was the same.
One thing that was consistent was people still got injured and those people still needed compensation. Warnken, LLC worked for those folks all year long. We concluded nearly 400 matters, obtaining excellent results. Warnken, LLC recovered at least $14,419,589.87 for the injured last year. (I say at least because some confidential settlements are not included in the numbers.)
We finished the year by recovering $501,185.62 for the injured in December 2020. Those cases are listed below.

- Injury: Displaced bimalleolar fracture of lower leg

- Claimant slipped and fell on ice while making a delivery. Claimant underwent three surgeries to the ankle, the last one being removal of hardware. Claimant was able to return to pre-injury employment driving trucks.

- Claimant developed heart disease as a result of the claimant’s career as a law enforcement officer.

- Claimant was struck in the knee by a student while working. Claimant underwent surgery to debride the knee and had post-operative therapy.

- Claimant stepped in a hole while working causing injury to the knee. The claimant reopened the claim for additional medical treatment, which included a series of injections.

- Amount: $50,000.00 ($43,642.00 plus MSA of $6,358)
- Claimant sustained injury after falling at work. Claimant underwent knee replacement surgery. Claimant sought a revision knee replacement surgery, which was denied by the Commission.

- Claimant was at work and slipped and fell sustaining injury to the leg. Claimant originally underwent surgery to repair a ruptured quad tendon. Claimant subsequently returned for additional treatment due to worsening symptoms and was treated with a cortisone injection and physical therapy.

- Claimant slipped and fell at work sustaining injury to the knee. Claimant was treated with medication, bracing, and physical therapy. An MRI performed showed a bucket handle type tear of the medial meniscus, chronic complete tear of the ACL and a low-grade medial compartment chondrosis. Claimant underwent surgery in the form of arthroscopic cruciate ligament reconstruction with quadruple stranded hamstring autograft, and arthroscopic with debridement of a large medial meniscal bucket handle tear. Claimant completed a course of post-operative rehabilitation as well as a Functional Capacity Evaluation.

- Claimant was involved in a motor vehicle collision during the course of their employment and sustained injuries to their neck and back. Claimant was evaluated at the emergency room and underwent diagnostic studies. An MRI to the cervical spine was performed and showed mild degenerative changes. An MRI of the thoracic spine was performed and showed a small C7-8 disk protrusion. Claimant was treated with cervical trigger point injections to the neck. Claimant also completed a course of physical therapy.

- Claimant was working as a prep foreman when moving a 1,200 lb. floor grinder sustained injury to the neck. Claimant was evaluated at the emergency room and given an injection. An MRI was ordered by a neurosurgeon and showed a lateral disk protrusion at C4-5. Clamant underwent surgery in the form of a C4 through 6 anterior cervical discectomy and fusion. Claimant also completed a course of rehabilitative therapy.

- Claimant was at work repetitively lifting heavy boxes and sustained injury to the shoulder. Claimant underwent surgery to repair a rotator cuff tear and had physical therapy.

- Client sustained head, neck, back and knee injuries in a work-related motor vehicle collision. The worker’s vehicle was struck by a hit and run driver. The injured worker underwent conservative care and returned to work for the same sedan service. Client continues to pursue an uninsured motorist claim against the automobile insurance policy in effect at the time of the collision.

The wrist was diagnosed with extensor tendinitis with a ganglion cyst as well as a trigger finger at the little finger. Worker underwent a dorsal ganglion cyst excision and a trigger finger release. Post-surgery, worker returned to work in the same field with a different employer.

- Truck loader sustained a back injury unhooking and moving trailers in the yard. This injury aggravated prior back injuries. After six months of conservative care, injured worker returned to work with a new employer.

- Client was working part-time at a model home when she tripped and fell when entering one of the room in which the floor transition was a different level. Worker sustained injury to the leg and ankle/foot. After coming under the care of a foot and ankle specialist, worker was diagnosed with sinus tarsi of the foot and underwent non-surgical care. Client has serious unrelated medical issues that interrupted post-injury medical care.

- Kitchen worker sustained a lifting injury moving a full grease pan. The injury was super-imposed on prior work-related herniated disc injury from two years prior.

- While attempting to remove the cap off of a truck, the claimant was struck with the gas cap, injuring their back, neck, and ribs. An MRI of the lumbar revealed a bulge at L2-3. Claimant underwent conservative treatment in the form of physical therapy and medications, before being released back to full duty with the same employer.

- While attempting to exit the work vehicle, the worker struck the side of their leg on the work truck, causing a traumatic injury to the leg. Claimant underwent a Doppler study which revealed saphenous vein phlebitis. After a course of mediation, the claimant was able to return to work at the same position.
